Agreement Terms

Service Overview
Azul Pool Co. provides weekly pool and/or spa maintenance based on the selected service level. Services are customized to each client’s needs and are not identical for all clients. Azul Pool Co. does not guarantee specific water clarity, cleanliness, or chemical balance at all times due to variables outside of its control.

Service Schedule & Billing
Service is structured as four (4) visits per month based on a 48-week service year. Four (4) non-service weeks are built into the pricing structure and no credits or adjustments will be provided for these weeks. These weeks include Thanksgiving week, Christmas week, and (2) additional weeks as needed during the year. In months with a fifth service week, four (4) visits are included unless additional service is requested and additional payment is made. Services are performed Monday through Friday. If a scheduled service visit is missed due to weather conditions, it will be rescheduled for the next available service day based on scheduling availability.

Rate Lock: Your current service rate is guaranteed for 6 months. While we aim to maintain consistent pricing, rates are reviewed periodically to align with changing economic conditions.

Services, Chemicals & Additional Charges
Routine maintenance is billed at a base service rate, with chemicals charged separately based on actual usage to ensure proper levels are constantly maintained. Services are performed in accordance with the selected service level; however, chemical requirements may vary depending on pool conditions. Certain conditions—including but not limited to storms, algae blooms, heavy debris, excessive usage, poor water quality, or equipment issues—may require additional chemicals, treatments, or service time, which will be billed separately. Automated chemical systems (including but not limited to IntelliChem or similar systems) dispense chemicals continuously and are billed based on actual consumption. Additional charges may apply for excessive debris removal, storm cleanup, return visits, or services outside the agreed scope. Filter cleanings are required twice per year and are billed at $150 per cleaning; these services are not included in the base service rate. Customers may opt to perform their own filter cleanings with proof of proper and complete service.

Payment Terms, Late Fees & Chargebacks
All invoices are due upon receipt, add a payment to your account and enjoy a worry free experience with auto-pay! Invoices not paid within fifteen (15) days of issuance will result in immediate suspension of service, and all outstanding balances for services rendered shall become due immediately, including any applicable late fees. A $15 late fee will be applied to any past-due invoices. In the event of a chargeback or payment dispute, the Client agrees to be responsible for the full original balance, a $50 chargeback fee, and any and all costs incurred by Azul Pool Co. in recovering the outstanding balance, including but not limited to administrative costs, collection fees, and legal expenses. Failure to maintain a valid payment method or resolve outstanding balances may result in termination of service at the Company’s discretion.

Repairs & Equipment
Repairs are not included in routine maintenance services and will not be performed without prior approval. All repairs must be authorized and paid prior to completion. The client is solely responsible for maintaining all pool and spa equipment, plumbing, and structural components in proper working condition. The Company is not responsible for damage or deterioration caused by faulty, aging, or improperly maintained equipment.

Client Responsibilities & Access
The Client agrees to maintain proper water levels at all times and to provide safe, unobstructed access to the pool/spa area, including access to gates, pets secured, and functioning equipment. Azul Pool Co. will add water to pools upon client request using the client’s water supply; however, Azul Pool Co. is not responsible for final water levels due to environmental or site-specific factors. Failure to provide access will result in the scheduled service being skipped without refund or credit. Azul Pool Co. shall not be held liable for any damages or service delays resulting from restricted access or unsafe conditions at the property.

Satisfaction, Termination & Liability
Our service is provided on a month-to-month basis. If you wish to cancel, please provide at least 30 days’ written notice. To avoid additional billing, we recommend submitting notice by the first of the month. Notice given mid-month will extend service for 30 days from the date received and may result in charges for a partial month in the following billing cycle. All payments are final and non-refundable. In the event of any service-related concerns, we will work with the client in good faith to reasonably address and resolve such matters; however, no refunds or credits will be issued. Azul Pool Co is not responsible for damage caused by weather, acts of nature, chemical imbalances, equipment failure, improper water levels, vandalism, or conditions beyond its control. Azul Pool Co. shall not be liable for staining, plaster damage, algae growth, or water condition issues resulting from external factors. Under no circumstances shall the Company’s liability exceed the total amount paid by the Client for services rendered. The Client agrees to hold harmless and indemnify Azul Pool Co. from any claims, damages, or liabilities arising from the use or condition of the pool/spa.

Acceptance of Terms
By signing, the Client acknowledges that they have read, understand, and agree to all terms outlined in this agreement and confirm they have the authority to enter into this agreement.
